These Terms of Use (“Terms”) govern your access to and use of the SHOWE mobile application, web application, and related services (the “App”).
By creating an account, downloading, accessing, purchasing content through, or using the App, you agree to these Terms. If you do not agree, you must not use the App.

1. Who We Are

The App is operated by The Showe Group Ltd (“SHOWE”, “we”, “us”, “our”).
SHOWE provides digital tools that allow venues, museums, galleries, producers, promoters, and event organisers to publish interactive digital programmes and related content through the App.

2. Our Role

2.1 SHOWE is a technology platform provider.
2.2 Content made available through the App is usually supplied by the relevant venue, organiser, producer, or other rights holder (the “Organisation”).
2.3 Where you access or purchase a digital programme or related content through the App, the contract for that content is between you and the Organisation, not SHOWE, unless we expressly state otherwise.
2.4 SHOWE may facilitate access, hosting, delivery, payment collection, account functions, and engagement features, but we do not act as the principal supplier of Organisation content unless expressly stated.

3. Eligibility and Account Registration

3.1 You must be at least 16 years old to use the App, unless a lower age is required by law for the relevant service and you have the necessary consent.
3.2 If you create an account, you agree to:

• provide accurate and current information;

• keep your login credentials secure;

• not share your account with others;

• notify us promptly of any unauthorised access or suspected security issue.

3.3 You are responsible for all activity carried out through your account.
3.4 We may suspend or restrict your account if we reasonably believe it has been misused or that these Terms have been breached.

4. What the App Does

The App may provide some or all of the following features:

• interactive digital programmes;

• venue and event information;

• QR code access to content;

• digital programme library;

• event tools and interactive features;

• ticket wallet integrations;

• venue messaging;

• travel and venue information;

• advertising or sponsored content;

• account-based favourites and preferences;

• notifications and reminders.

Feature availability may vary depending on the Organisation, the event, your device, and the version of the App.

5. Access to Content

5.1 Some content may be free and some may require payment.
5.2 Content may be:

• time-limited;

• event-linked;

• access-controlled by QR code, account, or event permissions;

• cached temporarily on your device where the App allows it.

5.3 Access rights may expire in line with the Organisation’s settings, event timing, licensing arrangements, or technical restrictions.
5.4 You receive a limited, non-exclusive, non-transferable, personal licence to view and use content through the App for your own personal use only.
5.5 You must not copy, redistribute, publicly communicate, resell, or otherwise exploit content unless you have the relevant permission from the rights holder.

6. Purchases and Payments

6.1 Where a programme or feature requires payment, the price and purchase terms will be shown before you complete the transaction.
6.2 Payment may be processed:

• through a venue or Organisation website;

• through an integrated third-party payment provider;

• or through SHOWE acting as a payment facilitator or agent on behalf of the Organisation where stated in the App or purchase flow.

6.3 Where SHOWE facilitates payment on behalf of an Organisation, the underlying contract for the content remains between you and the Organisation unless otherwise stated.
6.4 Refunds, cancellations, and disputes are handled in accordance with the relevant Organisation’s terms and applicable law.
6.5 You are responsible for ensuring your payment details are accurate and that you are authorised to use the chosen payment method.

7. QR Codes and Access Controls

7.1 Some content can only be accessed using QR codes, access links, account permissions, or event-specific access rights.
7.2 You must not misuse, publish, share, or attempt to bypass access controls in a way that undermines the intended experience or payment model.
7.3 We may disable or revoke access where we reasonably believe a code, token, or access right has been misused, expired, or is otherwise invalid.

8. Acceptable Use

You must not:

• copy or redistribute programmes or other content without permission;

• reverse engineer, decompile, scrape, or interfere with the App;

• attempt to bypass payment or access controls;

• upload harmful code, malware, or malicious content;

• use the App for unlawful, misleading, abusive, or fraudulent purposes;

• attempt to access another user’s account or data;

• abuse notifications, messaging, or interactive features;

• interfere with the security or operation of the App.

We may suspend, restrict, or terminate access where we reasonably believe you have breached this clause.

9. Notifications and Personalisation

9.1 The App may send notifications such as:

• event reminders;

• programme updates;

• venue messages;

• feature alerts;

• offers or recommendations, where permitted.

9.2 Your notification preferences may be managed in the App where available.
9.3 Some event-related notifications may be essential for the functioning of the App and may not be switchable if they are required for the service.
9.4 Location-based alerts may require your explicit device permission.

10. User Content

10.1 The App may allow you to save favourites, notes, reflections, or other personal items.
10.2 You remain responsible for any User Content you submit, store, or publish through the App.
10.3 You must not submit User Content that is unlawful, defamatory, infringing, offensive, deceptive, or otherwise inappropriate.
10.4 We may remove or restrict User Content that breaches these Terms, the law, or the rights of others.

11. Data and Privacy

11.1 We process personal data in accordance with our Privacy Policy and applicable data protection law.
11.2 This may include:

• account data;

• purchase history;

• access history;

• favourites;

• preferences;

• engagement data;

• technical and device data;

• notification settings;

• wallet or ticket-related data where enabled.

11.3 Some of this data may be used to operate the App, personalise your experience, improve the service, provide analytics, or meet legal and security obligations.
11.4 Where an Organisation provides content or operates an event through the App, that Organisation may also process your personal data under its own privacy information and lawful basis.
11.5 Where required by law, we will rely on consent, contract, legitimate interests, or another lawful basis as appropriate.

12. Third-Party Services

12.1 The App may include links to or integrations with third-party services such as ticketing providers, payment providers, transport services, or venue websites.
12.2 We are not responsible for the content, security, availability, or practices of third-party services.
12.3 Your use of third-party services may be subject to separate terms and privacy policies.

13. Availability and Changes

13.1 We aim to provide a reliable service but do not guarantee that the App will always be available, uninterrupted, or error-free.
13.2 The App may be unavailable or degraded due to maintenance, network issues, device limitations, platform updates, or third-party outages.
13.3 We may update, modify, suspend, or discontinue features from time to time.

14. Intellectual Property

14.1 The App, including its software, design, branding, layout, workflows, and platform features, belongs to SHOWE or its licensors.
14.2 Content made available through the App belongs to the relevant Organisation, rights holder, or other third party.
14.3 Except as expressly allowed in these Terms, you must not reproduce, modify, distribute, or commercially exploit the App or its content.
14.4 No ownership rights are transferred to you by your use of the App.

15. Termination

15.1 You may stop using the App at any time.
15.2 We may suspend or terminate your access immediately if:

• you breach these Terms;

• we reasonably suspect fraud, abuse, unlawful activity, or security risk;

• we are required to do so by law;

• the App or account is being used in a way that harms us, other users, or an Organisation.

15.3 Where your account is closed, some data may be retained as required by law, for legitimate business purposes, or in accordance with our Privacy Policy.

16. Liability

16.1 Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
16.2 The App is provided on an “as is” and “as available” basis, subject to your statutory rights.
16.3 To the fullest extent permitted by law, SHOWE is not liable for:

• event cancellations or changes;

• venue errors or omissions;

• ticketing issues caused by third parties;

• loss of enjoyment;

• indirect or consequential loss;

• loss of profit or revenue;

• loss caused by your misuse of the App or content.

16.4 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
16.5 Your statutory consumer rights are not affected.

17. Changes to These Terms

17.1 We may update these Terms from time to time.
17.2 If a change is material, we will use reasonable efforts to notify you.
17.3 Your continued use of the App after the effective date of the updated Terms means you accept the revised Terms.

18. Governing Law

18.1 These Terms are governed by the laws of England and Wales.
18.2 The courts of England and Wales shall have exclusive jurisdiction, unless applicable law requires otherwise.
